The artwork, all digital
and graphical images, and
text contained in the CD-ROM package
are protected by international
copyright laws, and all rights are reserved. The use and
limited reproduction of the artwork, images,
and text by the purchaser is
allowed only for limited personal, non-business use.
Some images are colour
enhanced and altered versions of
original artwork. These digital files are
designed by the Graphic Arts Department at
Australian Country Quilts and are copyrighted. If you
would like to purchase a license to reproduce images, please
fill in the
request form and information on an
ACQ

form.
ACQ
Graphics are NOT allowed to be used on an Online Email
Greeting Card Site. Images are not
allowed to be used in your emails. We
realise this is very difficult, most people choose not
to give credit in these cases which causes
ACQ images to end up as Public Domain
images where no one knows who they
belong to.
ACQ images are NOT allowed to be
used to make Auction Templates or Web Sets that you would sell
to others. Auction templates and Web Sets can be used over and
over again and sold over and over again and you have to
provide the customer with the graphic
images and background used in the template or set which
would mean then that you would be selling
ACQ artwork, which is against ACQ
rules. You may however, once you've purchased
ACQ graphic images, use
the images to decorate your OWN
auction pages and web pages as long as you give proper credit
on each auction page and website that you use
ACQ images or backgrounds on.
A separate
license
agreement is required for reproduction of any portion or
use of any portion of this work for business or commercial
purposes. Presenting the images of this work as part of a
pattern, website, e-Newsletter or advertisement is forbidden
without prior written consent of -

What Is Copyright?
Copyright gives exclusive legal rights of usage of an
"original work of authourship" to
the copyright holder. This protection is provided by the
Australian Copyright Council and
other international laws. Anyone who violates copyright is
subject to criminal penalties, fines, and the possible
recovery of any loss of income or profit suffered by the
copyright holder due to the infringement. An infringer is also
potentially liable for attorneys fees and statutory damages.
If I
change/manipulate an image using a
computer program or other method, can I claim copyright to the
changed image?
No. You cannot claim copyright to an
already copyrighted image from
Australian Country Quilts image
collection. You do not have permission by any law to
change images from the original
material without our permission.
Do not create another
graphic out of them.
Do not make a banner, logo, navigation
buttons or an award or any other graphic out of them. If you
want to incorporate them into a graphic you want to make, such
as a banner, button set, etc.
Are all images on
Australian Country Quilts products
copyrighted?
Yes. All our images and instructions are copyrighted. This
includes our CD-ROM products and
other images on our website.
How can I use images
I have purchased from ACQ?
The licensing agreement included with the purchase of a CD-ROM
allows the Personal
Use Only this
means ACQ images can be used
on a personal website about you or your family, your hobby,
etc.. where you Do Not sell or advertise anything. Non-Profit
groups- if you sell or advertise anything from your webpage(s)
you are considered to be a non-personal, business website.
Credit must be given to Australian Country
Quilts on each webpage that any
Graphic images are placed on.
Making copies of images
or CDs and distributing them to anyone else (say a
friend or family member) is strictly
prohibited. Any commercial use of ACQ
images requires permission in the form of a purchased license
for such use.
What should I do if
I am not sure how I want to use an image
infringes copyright?
If you are in doubt, always ask! The
Australian Country Quilts licensing agreement allows
the purchaser to use the images for personal use only. If you
intend to use our digitized graphical
images in a way other than personal use, you must ask
us for clarification and obtain permission from
Australian Country Quilts. We will
take into consideration
the intended use on an individual
basis and apply a additional usage fee.
Is it okay to copy a
digital image and give it to my friend to use?
No. Australian Country Quilts (ACQ)
images, and instructions are for the purchaser's personal use.
When you purchase one of our Labels
CD-ROM collections you have ready to use images
for use in your own craft projects.
Hundreds of hours have
been invested in collecting and
digitizing and enhancing our vast
selections of images.
ACQ hires graphic
artists, craft designers, writers, and computer software
developers and programmers to create our one of a kind
collections of products.
Time, cost
of promoting, advertising, and distributing our products
to our customers cost a great deal of
money. We thank you for your respect and understanding by not
copying our products illegally. This will help us to stay in
business and continue to bring you more wonderful images to
use.
Who is going to
know, if I copy an
image for a friend?
Copyright infringement is serious business.
Personal prosecution of illegal copyright
infringement starts at AUD$20,000. Business being prosecuted
can expect to pay a minimum of AUD$50,000 liability for each
breach of copyright. You decide if
you can afford to the serious consequences including
fines, loss of personal equipment, criminal charges, and
repaying the copyright holder for any loss of profit.
Does
'Personal Use
Only' mean
I can't use images to make and sell projects at a craft sale
or give away?
Our goal is not to curb your creative use of our products, you
may give away projects you make personally but if any money is
being traded on something you make with any
ACQ images, that is
commercial business, not personal. You
must contact Australian Country Quilts
and obtain our permission and a commercial license.
We do offer a small business licensing contract at an
affordable price specifically for cottage industry
manufacturing. Please see our form and information on our
licensing page.
I would like to use
an image on my personal business card.
Is that okay?
Yes. An individual can use an image on a personal
business card. However, a small business cannot use our images
without first applying for a license
allowing small production runs.
If you have a small little
shop in town, or just a business run from a website online,
and you purchase ACQ images to use
on items you make or to sell individual
items retail, you require an
ACQ
Small Business License to sell these items.

Images are NOT allowed to be used to create the following
items:
A. Digitized embroidery design files
for sale or to be given away
B. Stickers that you sell
C. Rubber Stamps
D. Individual Quilt
Labels for sale
E.Cross-Stitch
Patterns that you sell
UNLESS a $15.00 per graphic/image
fee is paid first. If you are interested in, for example,
digitizing one of my images and selling the digitized file so
others can sew out the design, you would first email
ACQ with a list of images that you
are interested in. We will
search our records to ensure no
other company or individual has already purchased the
exclusive digitizing rights to that image(s). If the image(s)
is still available you would then be able to pay the $15.00
fee for the exclusive digitizing rights to that particular
image. Once you have completed the form and
paid the fee, the images becomes
exclusive to you. This applies to all of the images
created on CDs, collections or have available for sale.
What is Commercial use(Business
use)?
Commercial use includes the production or display use of
ACQ images. Commercial use includes
small business, advertising campaigns, e-Newsletter
distribution, product or image resale, and production of
products. To use ACQ images in any
of these ways requires the purchase of a commercial license
(legal contract) for usage and notice to
Australian Country Quilts for intended

When you purchase art
from the Australian Country Quilts
on CD-ROM or in download form, you are purchasing images for
personal use only. Any time money is exchanged for an item
that is made with an ACQ image, it
is commercial business, not personal.

Small
Business Licensing
All ACQ are
produced at a high resolution, colour
corrected and graphically enhanced
to make them identifiable as copyrighted artwork.
If you intend to use
ACQ enhanced/digitized images
in a way other than personal use, please print and fill out
the form below. Our licensing fee is $25 per image for up to
250 uses. If you would like to license images for this
quantity of reproductions, please print, fill out and send the
form below with your Credit Card details
or the number of images you are licensing.
